Following review of the Defendants Emergency Motion for Discovery Conference #136 , Plaintiff's Response #137 , and a February 5, 2020 letter from Ms. Waite's physician that has not yet been docketed, it appears that a deposition of Ms. Waite, not to exceed three hours, is possible on February 12, 2020, provided it take place at Ms. Waite's home before or after the doctor appointments scheduled for that date. As the timing of those appointments has not been provided to the court, the court is not able to provide the parties with a time for the deposition. The court recognizes that the deposition may need to be held outside of normal business hours, though it should not extend past 8 pm.Given the past difficulties the parties have had agreeing to a date and time for this deposition, Plaintiff is ordered to provide Defendant with the schedule for Ms. Waites 2/12/2020 medical appointments via email no later than 6 pm tonight, February 11, 2020. Counsel for Defendant shall select a time that does not conflict with the scheduled appointments and provide it to counsel for Plaintiff by 9 pm tonight. Should Defendant decide, upon receipt of Ms. Waite's schedule of medical appointments that the deposition must be rescheduled, counsel for Defendant must notify counsel for Plaintiff by 9 pm tonight and, at that time, must provide Plaintiff with two dates between 2/17 and 2/28 when counsel is available for a deposition at Ms. Waite's home. Plaintiff must select one of the two dates for the deposition and notify counsel for Defendant of the selected date by 9 am on 2/12/2020. In the event the deposition is not conducted by the end of February of 2020, Defendant may file a memorandum requesting sanctions to remedy the harm caused by the failure to depose Ms. Waite. The court will not consider any further extensions based on the unavailability of counsel for Plaintiff or the health of Ms. Waite.Finally, the court notes that its timely consideration of this discovery dispute was hindered because materials for the court to consider were submitted to a clerk's office employee via email. Counsel for both parties are reminded that all information parties wish the court to consider must be filed on the docket. Sensitive documents may be filed under seal. Mass. 2014) (as to communications between counsel and client that were in connection with the case before the court, "the Court would not require a privilege log The Court views such communications as presumptively privileged."), affirmed insofar as relevant, Civil Action No. 12-cv-11198-IT, 2015 WL 1037992 (D. Mass. Mar. 10, 2015). As to redacted documents not on the privilege log, this court is on record as being of the view that redactions of documents that contain some relevant information should be limited to redactions of privileged or otherwise confidential information. See Aronstein v. Ma. Mutual Life Ins. Co., Civil Case No. 15-12864-MGM, 2017 WL 2818993, at *5 (D. Mass. June 29, 2017). While there is a split, the weight of authority is to the effect that Federal Rule of Civil Procedure 34 requires the production of documents, not documents scrubbed of nonresponsive information. See id (citing and quoting cases). At the hearing, the court directed that, to the extent the defendant had produced documents from which it had redacted information on the basis that the redacted information was not relevant, the defendant should produce unredacted copies of those documents. As to privileged or confidential information that had been redacted from documents not listed on the privilege log, the parties should confer pursuant to Local Rule 7.1 about whether the documents would remain in redacted form or be produced subject to the parties' protective order. In his objection, Plaintiff asserts Judge Robertson failed to consider the appropriate scope of discovery and did not consider whether the deposition of Ms. Waite was proportional to the needs of the case. Having reviewed Judge Robertsons Memorandum and Order, this court finds the objection to be without merit. Judge Robertson explained in detail that in the context of this case the measure of emotional distress damages is of great significance and testimony regarding other sources for Plaintiffs emotional distress is, therefore, quite relevant. Additionally, Judge Robertson explained with specificity how the circumstances of this case, including the testimony of Plaintiffs therapist in the prior case, together elevate the importance of the issues about which Defendant seeks to question Ms. Waite, despite the passage of time and the lack of connection to the underlying substantive issues in this case. For the reasons stated in court at the hearing on plaintiff's motion, pursuant to Fed. R. Civ. P. 36(a)(6), the court rules as follows. The defendant, UPS is ordered to serve an answer to plaintiff's requests for admissions 1-5. These requests are not ambiguous and must be answered with specificity. As to requests 6, 7, and 13, UPS's objections on grounds that the plaintiff failed precisely to identify the charge or complaint to which the requests referred is sustained. Plaintiff is directed to re-serve these requests for admissions to the extent plaintiff desires to do so. Requests for admissions 19 and 20 address causes of action possibly filed against UPS by employees other than the plaintiff. UPS objected to these requests for admissions on grounds of relevance, among others. The relevance of these requests is not established at this time. The court therefore defers its final decision on these two requests until a pretrial conference or a specified time before trial. No costs or fees to either party. See Fed. R. Civ. P. 37(a)(5).
