Filing 8 Judge Mark G. Mastroianni: ELECTRONIC ORDER entered denying #7 Plaintiffs request for notice of default. Pursuant to Fed. R. Civ. P. 55(a), the clerk is required to enter a default when it is shown by affidavit or otherwise that the party against whom judgment is sought has failed to plead or otherwise defend. A party has twenty-one days from the time they are served with the summons and complaint to file a responsive pleading. Fed. R. Civ. P. 12(a). In his affidavit in support of his request for notice of default, Plaintiff represents that the record in this case shows that the Defendants herein were served by the United States Marshall [sic] with a copy of the summons together with a copy of the Plaintiffs complaint on the 3 day of June, 2019. This statement does not accurately describe the record in this case. Rather, the docket in this case shows that the complaint was filed on June 3, 2019 and the court did not issue summons until June 11, 2019. Once issued, the summons were provided to the U.S. Marshal to serve. Once service is made, the U.S. Marshal will notify the court and a return of service will be docketed. Since, at this time, there is no entry in the docket showing that the summons and complaint have been served on defendants, Plaintiffs request for notice of default is denied without prejudice as premature.
