September 14, 2020 Filing 7 Judge Nathaniel M. Gorton: ORDER entered. ORDER DISMISSING CASE(PSSA, 5)
September 14, 2020 Filing 6 Judge Nathaniel M. Gorton: ELECTRONIC ORDER entered. Petitioner Adam Halls petition for mandamus is DISMISSED for lack of jurisdiction. Halls prayer for relief reveals that he is seeking a writ of mandamus and order the S.J.C. to CLEARLY rule on all outstanding motions and appeals and to clearly rule on the [M]offett brief and all supplements so their rulings on the individual issues can be interpreted for further review and appeal. Pet. 6. To the extent that Hall is seeking... mandamus relief through an Order compelling a state court... to act... this Court lacks jurisdiction to do so. Dempsey v. Clerk, Supreme Judicial Court, No. CA 10-12044-PBS, 2010 WL 5283290, at *2 and n.6 (D. Mass. Dec. 15, 2010) (Saris, J.); Forsberg v. Land Court of Commonwealth of Massachusetts, No. CIV.A. 10-11701-RGS, 2010 WL 4008571, at *3 (D. Mass. Oct. 7, 2010) (Stearns, J.). Giving Hall the benefit of the doubt as a pro se litigant, the petition is not construed as being brought under 28 U.S.C. 2254 in light of the unavailable mandamus relief being sought. The Clerk shall enter a separate order of dismissal.(PSSA, 5)
