Filing 64 ORDER - Based on the foregoing, and on all of the files, records, and proceedings herein, the R&R 59 is ADOPTED IN PART and REJECTED IN PART. Accordingly, IT IS HEREBY ORDERED THAT: The motion of defendant Dr. Willis for summary judgment and/or statutory dismissal 47 is GRANTED. All claims against Dr. Willis are DISMISSED WITH PREJUDICE. The remaining defendants' motion to dismiss or for summary judgment 27 is GRANTED IN PART and DENIED WITHOUT PREJUDICE IN PART. The motion is DE NIED WITHOUT PREJUDICE as to plaintiff's Eighth Amendment Bivens claims against defendants Michael Abbott and Jorge Diaz in their individual capacities. The following claims are DISMISSED WITHOUT PREJUDICE: Plaintiff's claims under the Fe deral Tort Claims Act. Plaintiff's Bivens claims against the Federal Bureau of Prisons and the individual defendants in their official capacities. All other claims are DISMISSED WITH PREJUDICE. (Written Opinion).
