MEMORANDUM AND ORDER - 1. Defendant's Motion to Substitute Party Defendant (filing no. 42 ) is granted. Plaintiff's Motion to Deny Motion to Substitute (filing no. 46 ) is denied. 2. The Clerk of the court shall update the docket sheet in accordance with the Notice of Substitution (filing no. 17 ). The United States of America is the only Defendant and replaces Defendant Dr. Whittier. 3. Plaintiff's Motion to Amend Court Order (filing no. 53 ) and Motion to Deny Defendant' ;s Motion to Depose Plaintiff (filing no. 62 ) are denied. In accordance with this Memorandum and Order, Plaintiff's deposition may proceed on June 4, 2010. 4. Defendant's Motion to Limit Discovery (filing no. 60 ) is granted. MEMORANDUM AND ORDER - Service is now warranted as to Plaintiff's Federal Tort Claims Act claim against Defendant Whittier only. Plaintiff must complete and return the summons form which the Clerk of the court will provide. The Clerk of the co urt shall send ONE (1) summons form and ONE (1) USM-285 form to Plaintiff together with a copy of this Memorandum and Order. The Marshal shall serve the summons and Amended Complaint without payment of costs or fees. The Clerk of Court is directed to set a pro se case management deadline in this case with the following text: "February 16, 2010: Check for completion of service of summons." Plaintiff shall keep the court informed of her current address at all times while this case is p ending. Failure to do so may result in dismissal. All remaining claims, except for Plaintiff's Federal Tort Claims Act claim against Defendant Whittier, as detailed in the court's September 1, 2009, Memorandum and Order, are dismissed wit hout prejudice as against all Defendants.
