MEMORANDUM AND ORDER - After conferring with parties: 1) On or before June 29, 2012, William R. Mathias shall either: (a) obtain the services of counsel and have that attorney file an appearance on his behalf; or (b) file a statement notifying t he court of that is intends to litigate this case without the assistance of counsel. The failure to do so may result in an entry of default and/or default judgment against defendant Mathias. 2) William R. Mathias shall provide a copy of this memo randum and order to his undisclosed counsel. 3) On or before June 29, 2012, the defendant shall file his answer to the plaintiff's complaint. 4) All filings by defendant Mathias shall be sent to the Clerk of the Court, Robert V. MEMORANDUM AND ORDER - This matter is before the Court on defendant William R. Mathias Motion to Dismiss and/or Motion to Transfer (filing 14 ). The Court understands Mathias to be moving for dismissal pursuant to Fed. R. Civ. P. 12(b)(2) (lack o f personal jurisdiction) and Fed. R. Civ. P. 12(b)(3) (improper venue). And in the alternative, Mathias moves for a change of venue pursuant to 28 U.S.C. § 1404(a). For the reasons stated below, the Court denies all three motions. Ordered by Judge John M. Gerrard.
