MEMORANDUM AND ORDER ON DEFENDANTS' MOTION TO DISMISS OR, IN THE ALTERNATIVE, MOTION FOR SUMMARY JUDGMENT - The defendants' motion to dismiss, or, in the alternative, motion for summary judgment, ECF No. 8 , is granted in part. Specifically, the motion is denied insofar as the defendants seek dismissal pursuant to Rule 12(b)(1) or Rule 12(b)(6), but the defendants' motion for summary judgment is granted.
