ORDER by Judge Claire V Eagan - Savage's motion for leave to proceed in forma pauperis filed January 4, 2024 (Dkt. # 2) is denied. No later than twenty-one days after the entry of this order, or on or before February 16, 2024, Savage shall either (1) pay in full the $405 fees ($350 filing fee and $55 administrative fee) or (2) file an amended motion for leave to proceed in forma pauperis, on the court-approved form, and submit with the amended motion a copy of his inmate account statement for the six-month period immediately preceding the filing of the complaint. Savage's motion to amend filed January 23, 2024 (Dkt. # 3) is denied. If Savage intends to sue Cadat, he must file an amended complaint, on or before February 16, 2024: (1) reasserting his claims against Regalado, Adams, Smith, and Miller, along with any facts necessary to support those claims; (2) adding Cadat as a defendant; and (3) asserting any claims that he intends to bring against Cadat, along with any facts necessary to support those claims. The Clerk of Court shall send to Savage: (1) one blank motion for leave to proceed in forma pauperis (form OKND PRIS-ifp) marked "amended" and identified for Case No. 23-CV-0559-CVE-SH; and (2) one blank civil rights complaint (form PRIS-14), marked "amended" and identified for Case No. 23-CV-0559-CVE-SH, along with instructions for completing the form. ; setting/resetting deadline(s)/hearing(s): ( Filing Fee due by 2/16/2024, Miscellaneous Deadline set for 2/16/2024); directing court clerk to take action; denying #2 Motion for Leave to Proceed in Forma Pauperis; denying #3 Motion to Amend (Re: #1 Complaint, #2 MOTION for Leave to Proceed in Forma Pauperis , #3 MOTION to Amend Complaint ) (RGG, Chambers)
