Filing 136 OPINION AND ORDER: Mr. McCright has failed to exhaust his administrative remedies on his urinary issues and his claim of being assigned a broken bed. I GRANT summary judgment in favor of Defendants on those claims and DISMISS them without pre judice. Mr. McCright appropriately exhausted his administrative remedies as to (1) his claim of deliberate indifference as to his heart condition, and (2) his claim of deliberate indifference regarding the delay in receiving lidocaine patches after h is open-heart surgery. However, he hasfailed to demonstrate that a genuine issue of fact exists regarding those claims. Accordingly, I GRANT summary judgment in favor of Defendants on those claims and DISMISS them with prejudice. (Deposited in outgoing mail to pro se party on 3/30/21.) (dls) |
Filing 76 Opinion and Order: Because McCright has failed to exhaust his administrative remedies on his urinary tract issue, and because he has failed to demonstrate that a genuine issue of fact exists regarding his claim of deliberate indifference, I GRANT su mmary judgment on both claims with leave to amend. McCright has thirty (30) days in which to file an amended complaint.
