ORDER OF DISMISSAL: The Court DISMISSES Plaintiff's Complaint (ECF No. #2 ) for failure to state a claim. Plaintiff may file an amended complaint, within thirty days of the date of this Order, curing the deficiencies noted. Plaintiff is advised that if he fails to file an amended complaint, this action will be dismissed. The Court DENIES Plaintiff's Motion for Appointment of Counsel (ECF No. #3 ) because at this stage of the proceeding, he has demonstrated a sufficient ability to articulate his claims and has failed to demonstrate a likelihood of success on the merits. See Palmer v. Valdez, 560 F.3d 965, 970 (9th Cir. 2009). The Court DENIES Plaintiff's Motion (ECF No. #5 ) seeking printed copies of case law for his personal use.
