Defendants' Motion to Compel clearly sought a mandatory award of expenses under Rule 37(a)(5)(A), and Plaintiff chose not to address that portion of the Motion in any way in its one-page response. Further, although the effort to meet and confer about the underlying discovery dispute was cursory at best on both sides, Plaintiff's counsel agreed that the parties were at an impasse as to the dispute and stated that "my inclination is to say go ahead and file a motion to compel" which is what Defendants' counsel did. Plaintiff has shown no justifiable legal or factual reason why it should be given a second bite at the apple to reargue this Motion to the Court. So Ordered by Magistrate Judge Lincoln D.
