Filing 68 MEMORANDUM AND ORDER granting Government's 57 Motion for Summary Judgment as to Counts I, II, III, and IV of the Complaint: the Court finds that defendants Giordano and Montecalvo used $4,246,793 of project funds in violation of the M t. St. Francis regulatory agreement. The Court also finds that Giordano, Montecalvo and Coventry Health Center Associates used $1,806,849 of project funds in violation of the Coventry Health Center regulatory agreement. Finally, the Court als o finds that double damages against defendant Giordano are warranted in this case. -- The Government is ordered to file a detailed brief (with time records) supporting its motion for attorney's fees (as requested in the Government's 57 Motion for Summary Judgment): the Government's brief is due by October 24, 2012. Defendants shall have until November 15, 2012 to file a response to the Government's request for attorney's fees. So Ordered by Chief Judge Mary M. Lisi on 10/4/2012.
