Counts I and III are DISMISSED. Plaintiff shall show cause within thi rty days why Count II as to Vernancio should not be dismissed given the lack of evidence supporting vicarious liability noted above. Furthermore, within thirty days the parties shall provide a status report regarding the pending third-party claim by Defendants against Verizon, which has been stayed pending arbitration.
