TEXT ORDER granting #4 Motion for Leave to Proceed in forma pauperis. After reviewing the Petitioner's inmate account statement, his motion to proceed IFP is GRANTED. Although he generally alleges various constitutional violations, such claims are conclusory and not presently supported by sufficient factual allegations to state viable civil rights claims under 42 USC sec. 1983. However, the crux of the Petition is a claim that Petitioner is "being illegally detained" (ECF Doc. No. 1 at p. 1) and he "pray[s] for release from unlawful incarceration" (ECF Doc. No. 6 at p. 6). Accordingly, the case is properly treated as one seeking habeas corpus relief under 28 USC sec. 2254, and, pursuant to Rule 5 of the Rules Governing Section 2254 Cases, the Attorney General is hereby ordered to file its response to this Petition on or before October 21, 2018.
