TEXT ORDER #20 Motion to Dismiss for Failure to State a Claim. GRANTED absent any timely filed opposition by Plaintiff and for the reasons stated in Defendant's Unopposed Motion to Dismiss. However, out of deference to Plaintiff's pro se status and in light of the Court's prior Order pursuant to 28 USC sec. 1915 limiting and construing Plaintiff's Complaint as only stating a claim as to his medical care while at the Wyatt Detention Facility, Plaintiff is GRANTED leave to file an Amended Complaint in compliance with that Order and Rules 8 and 10, Fed R Civ Proc, against the Wyatt alleging a denial of appropriate medical care which alleges more detailed and specific facts as to his allegations and the legal bases for his claim(s). Plaintiff shall file such Amended Complaint within 30 days. Failure to file an Amended Complaint in compliance with this Order and the applicable rules will result in dismissal of this action. TEXT ORDER: The Court has reviewed the Complaint under 28 U.S.C. 1915, and has determined that Mr. Mothersell alleges a complaint of lack of appropriate medical care at the Wyatt Detention Facility, where he is currently detained. (He also complains that he did not receive appropriate care at FBOP Cannan, Allenwood and McCurry.) Because the Complaint states plausible claim for relief under against Wyatt, the Court orders that the Central Falls Detention Facility Corporation be listed as the Defendant in this case and that the summons and complaint (and a copy of this Order) be served upon Wyatt.
