TEXT ORDER: At the Rule 16 conference in this case held on April 29, 2020, the parties agreed that the scheduling order should not enter and discovery should not proceed until they have had an opportunity to inspect the premises where the incident is alleged to have occurred to determine whether the named defendants are the entities responsible for those specific premises, and, if not, to reach agreement regarding possible dismissal of the complaint. The site inspection has been delayed due to the Covid-19 health crisis. Based on the foregoing, by May 29, 2020, Plaintiff is ordered to file a status report advising (1) whether the site inspection has occurred, and if it has not, when the parties expect it to occur and what is the ongoing reason for the delay; (2) whether he plans to proceed with this case; (3) if he does, who will be representing him in the case and when (if not already done) that attorney will enter an appearance. Depending on the content of the status report, the Court will (a) schedule again the Rule 16 conference for the purpose of the filing of the Rule 16 statement and the entering a scheduling order; (b) continue the conference for a specified period; or (c) issue a show cause why the case should not be dismissed without prejudice..
