TEXT ORDER denying without prejudice #3 Motion to Appoint Counsel - So Ordered by District Judge Mary S. McElroy on 4/8/2020. (Urizandi, Nisshy) |
Filing 4 ORDER: This Complaint falls short of stating a federal claim upon which relief can be granted. For that reason, I deny Mr. Perez' Motion to Proceed in Forma Pauperis (ECF No. #2 ) and dismiss this Complaint (ECF No. #1 ) without prejudice to his amending it, within the next 30 days, to state a federal claim. If and when he succeeds in re-framing his Complaint to pass federal constitutional muster, the lurking statute of limitations question can be addressed - So Ordered by District Judge Mary S. McElroy on 4/6/2020. (Urizandi, Nisshy) |
