June 21, 2021 Opinion or Order TEXT ORDER: Pursuant to the review required by to 28 USC 1915(e)(2) and 1915(A), the Court dismisses the claim of wrongful eviction. The plaintiff has litigated that claim, based on state law, to final judgment in the state court. With respect to the claim brought pursuant to the Americans with Disabilities Act (ADA), it is unclear whether the plaintiff has named K.C. Brody as a putative defendant or merely as the state-court attorney for the defendant landlords. If the former, Mr. Silvia fails to state a claim for relief under the ADA, and Attorney Brody is dismissed from the action. On the remaining claim made pursuant to the ADA against defendants Jonathan and Gladys Osorio, the Application to Proceed In Forma Pauperis (ECF No. #2 ) is GRANTED. The United States Marshals Service is hereby ordered to serve the plaintiff's summonses and complaint on the defendants. So Ordered by District Judge Mary S. McElroy on 6/21/2021. (Urizandi, Nisshy)
