Filing 6 REPORT AND RECOMMENDATIONS re #2 MOTION for Leave to Proceed in forma pauperis filed by Jesus Maldonado Objections to R&R due by 6/13/2023.. I find that Plaintiff's complaint (comprising ECF Nos. 1 and 5) fails to state a claim and recommend that it be dismissed at screening. However, before the complaint is dismissed, I recommend that Plaintiff be afforded thirty days to file an amended pleading that states a viable claim, as well as that he must file the inmate account summary required by 28 U.S.C. 1915(a)(2) for the six-month period preceding the filing of his complaint in order for his IFP motion to be granted. If Plaintiff fails to file an amended pleading or if the amended pleading fails to state a claim, I will recommend that this case be dismissed with prejudice.
