TEXT ORDER: After a review pursuant to 28 U.S.C. 1915, this Court DISMISSES Plaintiff's Complaint because this federal court does not have subject matter jurisdiction and the complaint fails to state a claim upon which relief can be granted. Mr. Acosta alleges an "environmental hazard, free stump, sidewalk / awareness for years / address the safety hazard" (page 5). Allegations such as this, if they state a cause of action, likely should be filed in a state court. Further, finding as moot #2 Motion for Leave to Proceed in forma pauperis. So Ordered by Chief Judge John J. McConnell, Jr. on 9/14/2023. (Jackson, Ryan)
