TEXT ORDER: The Plaintiffs Motion to proceed in forma pauperis (ECF No. #2 ) is DENIED. The Court is required to review complaints pursuant to 28 U.S.C. 1915(e)(2) and 1915 (A) when ruling on motions to proceed without prepayment of fees. Having done so the Court concludes that Mr. Callahan has failed to state a claim upon which relief may be granted. State entities cannot be sued for damages under 42 USC 1983, Will v. Michigan Dept of State Police, 491 U.S. 58, 71 (1989). Confinement 20-22 hours/day to a cell is not sufficiently extreme alone to constitute an Eighth Amendment violation. Figueroa v. Dinitto, 52 Fed. Appx. 522, 523 (1st Cir. 2002). The complaint also fails to put forth a viable First Amendment claim. So Ordered by District Judge Mary S. McElroy on 11/15/2023. (Potter, Carrie)
