March 7, 2024 Opinion or Order TEXT ORDER. The petitioner's Motion for an Order Restraining Suits (ECF No. #2 ) is DENIED WITHOUT PREJUDICE. Rule F of the Supplemental Rules for Admiralty or Maritime Claims and Asset Forfeiture Actions of the Federal Rules of Civil Procedure requires that limitation of liability actions such as this one be filed within "six months after receipt of a claim in writing." The petitioner notes that a compliant was filed against it on August 8, 2023, in the matter of Norvel Ferguson, et al. v. The Interstate Navigation Company d/b/a The Block Island Ferry, et al., 1:23-cv-00326. While the instant complaint was filed within six months of service of the Ferguson complaint, the petitioner has provided no verified statement or evidence that this was the first receipt of a claim in writing. The petitioner may refile its Motion evidencing the timing of receipt of the claim within 20 days of this Order. So Ordered by District Judge Mary S. McElroy on 3/7/2024. (Potter, Carrie)
