TEXT ORDER: The plaintiff's Motion for Leave to Proceed in Forma Pauperis (ECF No. #2 ) is GRANTED. He still must, however, pay the statutory filing fee of $350.00 for this action. He must pay, when funds exist, an initial filing feeof the greater of 20% of the average monthly deposits to his account or the average monthly balance for the six months prior to the filing of the complaint. Subsequently, he must pay monthly 20% of the previous months income credited to his account. 28 U.S.C. 1915(b)(1) and (2). The average monthly balance over the preceding period is $3.86 and the average monthly deposit during that same period is $201.80. Therefore, Mr. Crook is required to make an initial payment of $40.36 to the extent that funds are available in his account in excess of $10.00, and the ACI is directed to forward to the Court each month 20% of the previous months income to his account each time that amount exceeds $10.00 until the entire filing fee of $350.00 is paid..
