TEXT ORDER: Plaintiff's Motion to Reconsider #6 is DENIED. Plaintiff has failed to plausibly allege that this Court has subject matter jurisdiction. On both the Civil Cover Sheet (ECF No. 1-10) and in the Complaint (ECF No. 1), the Plaintiff alleges diversity jurisdiction. There is no basis for admiralty jurisdiction in this case which involves a 1994 Mustang motor vehicle and an engine. The amount in controversy does not meet the $75,000 threshold the engine involved and the car itself are each valued at under $10,000 and the Plaintiff alleges he paid $7,600 for repairs. This matter should be brought in state court. So Ordered by Chief Judge John J. McConnell, Jr. on 5/24/2024. (Simoncelli, Michael) |

TEXT ORDER: After reviewing the Plaintiff's response to this Court's Show Cause Order, it is clear to the Court that it does not have subject matter jurisdiction and therefore this matter must be dismissed. The Plaintiff has not adequately and plausibly alleged either diversity or federal question jurisdiction, therefore this case cannot proceed in this court. So Ordered by Chief Judge John J. McConnell, Jr. on 4/24/2024. (Simoncelli, Michael) |
