TEXT ORDER dismissing Plaintiffs' #1 Complaint and denying as moot Plaintiffs' #6 Emergency Motion for Priority on the List to Reestablish the Loan. The Court lacks subject matter jurisdiction over Plaintiffs' claims under the Rooker-Feldman doctrine. See White v. Gittens, 121 F.3d 803, 806 (1st Cir. 1997) ("[A] court has an obligation to inquire sua sponte into its subject matter jurisdiction, and to proceed no further if such jurisdiction is wanting." (quoting In re Recticel Foam Corp., 859 F.2d 1000, 1002 (1st Cir.1988))). The Rooker-Feldman doctrine holds that a court may not exercise subject matter jurisdiction over claims that are "inextricably intertwined" with claims that a state court previously decided. Hill v. Town of Conway, 193 F.3d 33, 39 (1st Cir. 1999). Claims are "inextricably intertwined" when they "succeed[] only to the extent that the state court wrongly decided the issues before it." Id. (quoting Pennzoil Co. v. Texaco, Inc., 481 U.S. 1, 25 (1987) (Marshall, J., concurring))). Specifically, the Court does not assess whether the federal court claims are identical to those from the state court, rather it considers "whether the plaintiff's federal suit is, in effect, an end-run around a final state-court judgment." Klimowicz v. Deutsche Bank Nat'l Tr. Co., 907 F.3d 61, 66 (1st Cir. 2018). This case is merely the latest installment in Plaintiffs' attempt to circumvent a prior state court action. In August 2023, the Providence/Bristol County Superior Court entered judgment against Plaintiffs in a foreclosure proceeding, which Plaintiffs did not appeal. See Amos Fin. LLC v. Granados, No. PM-2022-00782 (R.I. Super. Ct.); see also Kowalski v. Gagne, 914 F.2d 299, 305 (1st Cir. 1990) ("It is well-accepted that federal courts may take judicial notice of proceedings in other courts if those proceedings have relevance to the matters at hand."). Thereafter, Plaintiffs asserted claims in this Court based on the same mortgage and foreclosure as the state court case, which the Court dismissed under the Rooker Feldman doctrine. See Text Order, Caceres, et al. v. U.S. Bank Trust Nat'l Ass'n, 22-cv-00097 (D.R.I. Mar. 15, 2024). Like the Court's previous holding, it now finds that it may not exercise jurisdiction over Plaintiffs' claims because they involve the same underlying facts, property, mortgage, and plaintiffs as the state court action; said differently, a judgment in favor of Plaintiffs would effectively reverse the state court's holding. See Klimowicz, 907 F.3d at 66 (dismissing claims because "plaintiff seeks to challenge the validity of both the foreclosure and mortgage assignment matters falling squarely within the compass of the state-court judgments"). Accordingly, the Court DISMISSES Plaintiffs' #1 Complaint for lack of subject matter jurisdiction and DENIES Plaintiffs' #6 Motion as MOOT. So Ordered by District Judge William E. Smith on 7/29/2024.
