ORDERED that this action be and is DISMISSED WITH PREJUDICE for failure to state a claim, pursuant to 28:1915A(b)(1); that plaintiff's request to proceed in forma pauperis be and is DENIED AS MOOT; that plaintiff is advised that, pursuant to 28:1915(g), this dismissal may affect his ability to proceed in forma pauperis in future civil action; that the Clerk record this dismissal for purposes of the Prison Litigation Reform Act.
