If London fails to file a second amended complaint or if his second amende d complaint does not comply with the instructions in this order, the court will recommend to Judge Pepper that she dismiss this case on the grounds that it is malicious and that she assess London a strike. If London no longer wishes to pursue this ca se, he may voluntarily dismiss it. If he voluntarily dismisses the case, he will not be assessed a strike.
