Saris: ELECTRONIC ORDER entered denying without prejudice #2 Motion for Leave to Proceed in forma pauperis "Plaintiff's motion to proceed in forma pauperis is hereby DENIED without prejudice. Plaintiff has failed to provide a complete six-month prison account statement. See 28 U.S.C. 1915(a)(2). Rather, plaintiff provided an incomplete prison account statement that omits the three months' prior to the filing of the complaint. Furthermore, plaintiff lists a residential address on his complaint, but claims that he is incarcerated in his motion to proceed in forma pauperis. The Court is informed that plaintiff is no longer in custody at South Bay House of Correction. Accordingly, plaintiff shall by January 7, 2019, file a renewed motion to proceed in forma pauperis, or pay the $400 filing and administrative fee. To the extent plaintiff is a prisoner and seeks to proceed in forma pauperis, he shall comply with 28 U.S.C. 1915(a)(1) and (2), and file an appropriate affidavit and six-month account statement. Otherwise, to the extent that plaintiff is not a prisoner, and seeks to proceed in forma pauperis, he shall comply with 28 U.S.C. 1915(a)(1) and file an appropriate affidavit. The Clerk is directed to provide the plaintiff with a Form AO 240. Failure to comply with this Order may result in dismissal of this action without prejudice."
