October 14, 2020 Filing 101 USCA Case Number 20-1997 re #100 JUDGMENT of the USCA for the First Circuit. (Paine, Matthew)
October 14, 2020 Filing 100 JUDGMENT of the USCA for the First Circuit:Pursuant to 28 U.S.C. 1292(b), a district court may certify that an order is appropriate for interlocutory review when the order "involves a controlling question of law as to which there is substantial ground for difference of opinion" and when "an immediate appeal from the order may materially advance the ultimate termination of the litigation." Here, the district court certified that its order denying defendant-petitioner's motion to dismiss on personal jurisdiction grounds was appropriate for interlocutory review under 1292(b). Following the district court's 1292(b) certification, defendant-petitioner filed the current petition for permission to appeal in this court; plaintiff-respondent did not file a response. Having considered the district court's ruling and the petition filed with this court, we conclude that 1292(b) review would be appropriate. We express no view whatsoever at this time as to the merits of the personal jurisdiction dispute. Defendant-petitioner's 1292(b) petition is granted. The appeal shall proceed as 20-1997. All papers filed in Appeal No. 20-1831 will be treated as if filed in 20-1997. A briefing schedule will enter in the ordinary course. (Paine, Matthew)
