May 16, 2023 Filing 5 Judge Richard G. Stearns: ELECTRONIC ORDER entered. Target Corporation having filed its Answer, the court enters the following pretrial schedule. Initial disclosures required by Fed. R. Civ. P. 26(a)(1) must be completed by 6/12/23. All amendments to the pleadings and/or joinder of additional parties shall be completed by 8/7/23. The court will permit 30 interrogatories, 30 requests for admissions and 30 document requests without leave of court and expects those requests to be filed with the opposing counsel within 30 days of the initial disclosures (no later than 7/11/23). If the parties would like to participate in the courts mediation program, they must notify our docket clerk Arnold Pacho (617-748-9812) by 9/25/23 (it may take several weeks to get a mediation date). All fact discovery must be completed no later than 10/16/23. Plaintiff shall designate expert(s) and serve Rule 26(a)(2) reports no later than 11/10/23; defendants expert witness(es) will be designated and Rule 26(a)(2) reports filed no later than 12/7/23 (Any IME must be requested and completed during fact discovery). Although experts generally need to produce reports of their work in accordance with Rule 26, the court does not require treating physicians to produce expert reports. The parties accordingly may rely on treating physician records without following this notification procedure. However, in lieu of that report, plaintiff is responsible to produce his relevant medical records from those testifying physician early in fact discovery. This responsibility can also be accomplished by presenting defendants counsel with completed releases for relevant records and providers by 6/12/23 as part of automatic disclosures. Plaintiff is obligated to supplement his medical records with any relevant ongoing treatment under the procedural rules. Expert discovery must be completed by 1/5/24.Dispositive Motions (if any) are due by 1/26/24, with Oppositions due no later than 2/16/24; Reply, if any, by leave of court. (Zierk, Marsha)
