Plaintiff has explained that he provided the Marshals with his completed summons and complaint for service on Defendant on January 28, 2019, and there is no indication that this formal service of process has been completed. Nevertheless, he still requests a "Short Order of Notice," seeking an expedited hearing. Under Fed. R. Civ. P. 65(a)(1), "[t]he court may issue a preliminary injunction only on notice to the adverse party." The rule does not explain the type of notice that must be provided, but courts have held that something less than formal service of process under Fed. R. Civ. P. 4 may suffice. Accordingly, Plaintiff may either: (1) await formal service of process (through the Marshals or otherwise), after which the court will schedule a hearing on Plaintiff's motion for preliminary injunction once a return of service is filed with the court; or (2) he may seek to provide at least informal service of his Complaint and Motion for Preliminary Injunction on Defendant. If Plaintiff would like to choose the second option, he must file a motion setting forth his proposal for accomplishing informal service. If Plaintiff files and the court grants this motion, the court will then set a time frame for this informal service, provide a deadline for Defendant's response to Plaintiff's motion for preliminary injunction, and schedule a hearing on the preliminary injunction request. In addition, even if Plaintiff seeks informal service for purposes of his motion for preliminary injunction, he is still required to complete formal service of process under Fed. R. Civ. P. 4.
