Filing 7 NOTICE OF INSUFFICIENCY. The plaintiff has filed a motion for leave to proceed in forma pauperis; in other words, he seeks to commence a federal lawsuit without pre-paying the filing fee. A federal law, 28 U.S.C. 1915, permits him to do so if, among other things, he files a certified copy of his inmate trust account statement for the six-month period preceding his complaint. In this case, the plaintiff has filed the necessary documents, but a number of entries in his trust account statement demonstrate that his application to proceed in forma pauperis has not been filled out with the "particularity, definiteness and certainty" that the law requires. Escobedo v. Applebees, 787 F.3d 1226, 1234 (9th Cir. 2015). His application claims that he has received zero dollars from any sources in the past twelve months, but his trust account statement confirms that he has received thirteen outside deposits totaling over $2,700 in the past six months, including a $1,600 deposit on July 19, 2022. The trust account statement appears to confirm that the plaintiff is receiving regular and substantial support from a family member or friend. In determining if a plaintiff's financial circumstances qualify for in forma pauperis status, a court may consider not only his personal resources, but also resources that an applicant "has or 'can get' from those who ordinarily provide the applicant with the 'necessities of life.'" Fridman v. City of New York, 195 F. Supp. 2d 534, 537 (S.D.N.Y. 2002). The plaintiff has not provided any information about the resources of the family member or friend who is supporting him, and by extension he has not demonstrated an entitlement to in forma pauperis status. The plaintiff is therefore directed to file another application form that accurately sets forth the amount of money he has received and identifies the source of these deposits. The revised application must also include a statement of the source's financial resources. In particular, the plaintiff is directed to state the source of the $1,600 deposit, and to provide a statement of the source's financial resources. If he does not do so by November 14, his case may be dismissed. Finally, the plaintiff is respectfully reminded that the application form is signed under penalty of perjury and all of his entries on the form must be true, correct, and complete.
