April 21, 2009 Opinion or Order Judge Nancy Gertner: Electronic ORDER entered denying #94 Motion to Amend Complaint and Reconsideration to Add Defendants Pursuant to Rule 60 (b) by All Plaintiffs. "The plaintiffs' Motion to Amend or for Reconsideration #94 is DENIED. The plaintiffs previously sought to add exactly the same defendants in a motion to amend that was rejected, after thorough consideration, by Judge Dein in her October 15, 2008 Order (document # 87). See also July 30, 2008 Order (document # 71) (addressing the state housing court litigation that the plaintiffs now seek to incorporate in this lawsuit). The reasons stated by Judge Dein remain persuasive, even in light of the newest events and allegations of conspiracy that the plaintiffs now seek to add to this case. The lawsuit already involves more than 15 defendants -- including plaintiffs' previous neighbors, West Newbury town officials, and town police officers -- and some 25 separate claims relating to Kristi Devine's long-running property dispute with Jocelyn Mackey, Devine's subsequent arrests, and her wide-ranging allegations of conspiracy. As before, the Court will not permit the plaintiffs "to bring into one civil action such a complex array of claims and parties as results when multiple incidents involving different parties are allowed to proceed in one case." October 15, 2008 Order at 2 (citing Seaver v. Manduco, 178 F.Supp.2d 30, 39 (D.Mass. 2002)). The events involved in this lawsuit cannot be an ever-expanding universe; Devine's claim of a civil rights conspiracy will be amply tested by the allegations and parties already in the case and currently presented in the pending Motion for Summary Judgment #72 . Pursuant to its discretion under Fed.R.Civ.P. Rule 15(a), the Court declines to permit the amendment and DENIES the plaintiffs' Motion to Amend or for Reconsideration #94 ." (Gaudet, Jennifer)
