Plaintiff, a three striker, has filed a motion complaining that he cannot comply with my previous order limiting him to ten pages to file an amended complaint. This is Plaintiff's second case pending in this court. My Order instructs Plaintiff to choose either - inadequate medical care or inadequate mental health care claims - not already being pursued in his other pending lawsuit, explain how he is in imminent danger of serious physical injury, names only the Defendants who are involved in that specific claim, and explains how each Defendant, through his or her own actions, is being deliberately indifferent to his current, serious medical or mental health needs. Plaintiff seeks a mental health examination stating, inter alia, that his incarceration has caused his mental health to deteriorate. (This is a TEXT ENTRY ONLY. There is no pdf document associated with this entry.) ORDER granting in part #6 Motion to Extend Time. Plaintiff asks for more time to file an amended complaint. That request is granted and he may have until 8/3/2026 to file an amended complaint. The Clerk shall correct Plaintiff's mailing address to the Delta Regional Unit, 880 E. Gaines Street, Dermott, Arkansas 71368. Plaintiff's request for counsel is denied. A civil litigant does not have a constitutional or statutory right to appointed counsel in a civil action but the Court may appoint counsel at its discretion. 28 U.S.C. 1915(e)(1). The Court has considered Plaintiff's need for an attorney, the likelihood that Plaintiff will benefit from assistance of counsel, the factual complexity of the case, the Plaintiff's ability to investigate and present his case, and the complexity of the legal issues. In considering these factors, the Court finds that Plaintiff's claims do not appear legally or factually complex, and it appears he is capable of prosecuting his claims without appointed counsel. I recognize Plaintiff says he has mental health disabilities, but for now, he appears to be able to capably litigate this matter. Lastly, his request for a mental health expert is denied.
