Filing 13 NOTICE OF INSUFFICIENCY. The plaintiff's in forma pauperis application remains insufficient because it does not explain what he did with the $1800 that came into his account in March 2023. The revised application explains where the $1800 came from, but it does not explain where it went. When presented with an in forma pauperis application, the Court is entitled to know how the plaintiff spends his money. As one court explained, "[i]f the inmate thinks that a more worthwhile use of his funds would be to buy peanuts and candy... than to file a civil rights suit, then he has demonstrated an implied evaluation of the suit that the district court is entitled to honor." Lumbert v. Ill. Dep't of Corr., 827 F.2d 257, 260 (7th Cir. 1987).The Court will allow Mr. Johnson one more chance to adequately support his in forma pauperis motion. He must file a statement explaining where the $1800 went, to include an explanation of the April 27, 2023 $1600 special request, by September 14, 2023. If he does not do so, he will have neither paid the filing fee nor obtained leave to proceed without doing so, and his case may be dismissed.The plaintiff requests an application for appointment of counsel. Filing 5 NOTICE OF INSUFFICIENCY. The plaintiff has filed a motion for leave to proceed in forma pauperis; in other words, he seeks to commence a federal lawsuit without pre-paying the filing fee. A federal law, 28 U.S.C. 1915, permits him to do so if, among other things, he submits a financial affidavit showing that he is unable to pay, accompanied by a certified copy of his inmate trust account statement for the six-month period preceding his complaint. In this case, the plaintiff filed the wrong in forma pauperis form. Additionally, he filed a copy of his inmate trust account statement, but it is not certified by a prison official. His application is therefore insufficient. The Clerk of the Court is respectfully directed to send the plaintiff a blank copy of the correct application form at his address of record. The plaintiff is directed to fill out the form completely and accurately, and to file it with the Clerk of the Court along with a certified copy of his inmate trust account statement covering at least the period from February 10, 2023 to August 10, 2023. In his resubmitted application, the plaintiff must explain the $1600 "special request" that appears on his trust account statement for April 27, 2023 that is, he must explain who the money went to and for what purpose and he must sign the entire application under penalty of perjury.
