Minute Entry for proceedings held before Judge Joy Flowers Conti: Motion Hearing held on 6/21/2012 re #8 MOTION to Stay. As set forth more fully on the record, the court having been advised that no other actions have been filed against defendant MTS with respect to the accident which resulted in this interpleader action, and that there is no currently-known threat of litigation, the court denied without prejudice MTS's motion for an injunction (ECF NO. #8 ). As further set forth on the record, the court noted that the claims process run by the Special Master appears to be running smoothly, indicating that the broad exercise of power under the All Writs Act which MTS requested in its motion is unwarranted at this time. The court noted that an opinion will be forthcoming this summer resolving the cross-motions for summary judgment with respect to the Hallmark insurance policy, and that the court's resolution of MTS's motion to stay is without prejudice to MTS refiling the motion at an appropriate time, if the circumstances of the case change.
